Non-Prosecution Agreement (Florida NPA)

Edition label: 2026-10

Date: Signed September 2007;1 Epstein pled guilty in state court June 30, 20082
Parties: Federal government (SDFL, U.S. Attorney Alex Acosta) and J. Epstein3
Status: Contested;4 subject of OPR review (2019);5 cited in Maxwell’s appeal6

What It Was

A non-prosecution agreement negotiated by Alex Acosta’s office that conditionally deferred federal prosecution while Epstein completed specified state-court terms.7 Under the NPA: - Epstein pleaded to state charges8 (18 months;9 served approximately 13 months)10 - Federal prosecution was conditionally deferred; after timely fulfillment, the agreement provided for no prosecution in the district and dismissal of any charges.11 According to the July 28, 2008 defense reply brief, the USAO retained the continuing right to indict (or to unseal already-existing sealed federal charges) throughout the deferral period if Epstein breached.12 Federal grand jury subpoenas were held “in abeyance unless and until the defendant violates any term of this agreement”;13 evidence was preserved “inviolate.”14 The NPA let the U.S. Attorney give breach notice within 90 days after Epstein’s home confinement expired; OPR states he completed his sentence on July 21, 2010.15

Origins and Negotiations

The case originated as a Palm Beach Police matter21 and came to the SDFL around mid-2006.22 Line prosecutor Maria Villafana brought it to the office’s attention.23 Key negotiation timeline:

OPR Findings (November 2020)

Key findings:

Barr said the NPA’s denial of victims’ allocution rights was “pretty aggressive” and, in his view, legally vulnerable.50

The Villafana Contradiction

Acosta characterized line prosecutor Maria Villafana as supporting the negotiated resolution.51 OPR found the opposite — she drafted an 82-page prosecution memorandum, dated May 1, 2007, supporting a proposed 60-count indictment.52 Acosta acknowledged OPR’s characterization was “much stronger” than his recollection.53

Interstate Travel Nexus

Acosta testified that, at the time, the office did not have evidence that Epstein traveled interstate with victims, and said he knew of no victim statements describing such transport.54 Managing attorney Andrew Lourie thought the defense’s argument that Epstein did not travel to Florida with the purpose of engaging in illicit sex with a minor was more persuasive than its other points, while rejecting its argument against the § 2422(b) charge.55

Co-Conspirator Immunity Clause

The NPA states that if Epstein successfully fulfilled the agreement, the United States would not institute charges against any “potential co-conspirators,” including four named women;56 this wording was not an adjudication that they conspired.

Impact on SDNY Prosecution (2019)

Barr vaguely recalled Justice Department discussions about bringing charges that would not run afoul of the NPA.57 The NPA did not bar SDNY prosecution.58 Ghislaine Maxwell was subsequently indicted and convicted by SDNY;59 she has challenged that conviction partly based on NPA grounds.60

Maxwell § 2255 challenge (December 2025) — petition denied August 25, 2026

Ghislaine Maxwell’s pro se § 2255 motion (POINT FOUR) directly challenges the SDFL-only geographic-limitation reading.61 Maxwell argues that:

Maxwell’s December 17, 2025 habeas petition renews an argument she previously made in her pretrial motion to dismiss and in her April 10, 2025 certiorari petition.66 Judge Engelmayer denied the § 2255 petition on August 25, 2026 (SDNY 1:25-cv-10468).67 Whether the NPA barred prosecution in the Southern District of New York was contested: Maxwell’s collateral attack argued that it did, but the district court denied her petition on August 25, 2026.68 See Co-Conspirator Immunity Clause for the parallel annotation on the immunity clause itself.

Palm Beach Investigation Origins (Filthy Rich)

Filthy Rich traces the case from its origins: the Palm Beach PD investigation built by detective Joe Recarey under Chief Michael Reiter, received by State Attorney Barry Krischer, and ultimately escalated directly to the SDFL by Reiter.69 The book reports that Epstein served less than thirteen months of an 18-month sentence at the Palm Beach County Stockade, alone in his own cell and wing, with work release.70

The book Filthy Rich presents Reiter’s federal referral as a response to disagreement with Krischer’s handling.71
