Timeline

Physical Evidence Supporting Suicide

Per Barr’s deposition and confirmed/supplemented by OIG Report 23-085: - Medical Examiner: injuries more consistent with, and indicative of, a suicide by hanging rather than a homicide by strangulation;63 no defensive wounds;64 no marks on hands; no broken fingernails; no debris under nails; no knuckle contusions; no body bruising (one arm abrasion consistent with convulsing from hanging)65 - Toxicology negative for medications and illegal substances66 - Prior incident July 23 (contested — Code 228 charges not sustained);67 placed on suicide watch68 - Signed new Last Will and Testament August 8 (2 days before death)69 - Unmonitored phone call to personal contact August 970 (Barr recalled a call to someone he believed was a girlfriend in Byelorussia and interpreted it as consistent with saying goodbye71 — OIG: personal contact, identity not disclosed)72 - Cellmate transferred; Epstein alone; excess linens including multiple nooses in cell73 - Failed bail;74 Maxwell documents unsealed August 975 with extensive media coverage76 - Three interviewed inmates with sight of Epstein’s cell door told OIG nobody entered or exited that cell after his return.77

The “Perfect Storm of Screwups”

Barr’s phrase summarizing six decisions or failures preceding or occurring that night: 1. Removed from suicide watch78 2. No cellmate assigned79 3. 30-minute checks not performed80 4. Guards falsified logs81 5. DVR not recording (see dvr-failure)82 6. Institutional counts not done83

Homicide Theory — Dr. Michael Baden

Medical examiner Dr. Michael Baden said the autopsy findings were more consistent with homicidal strangulation than hanging.84 Barr recalled no one expressing agreement with Baden during his conversations.85 OIG found nothing contradicting the FBI’s no-criminality finding; Barr was not aware of an investigation concluding homicide.86

Physical Access — SHU

Barr argued that undetected access up the stairway was not physically possible:87 - SHU access requires remote central control door + key held by officers88 - Two eyewitness inmates on the same tier saw no one enter89 - “this would’ve required coordination from probably two dozen people maybe within the prison”90

FBI Independent Footage Review (July 2025)

The joint DOJ/FBI memorandum, labeled July 2025 in its PDF metadata,91 announced an independent FBI review of SHU footage:92

Contested Footage

CBS reported the following observations from the released footage and its experts’ analysis:97 - An “orange shape” on the stairs98 - A possible third unidentified individual99

Asked about the orange shape and a possible third person, Barr said he did not recall focusing on an orange shape100 and saw nothing of an unidentified person in the footage he reviewed.101 The camera directly covering Tier L was live-streaming but not recording due to dvr-failure.102

Two additional cameras (elevator bank,103 10 South Officers’ Station (adjacent unit; no view of the SHU)) were recording104.

OIG Report Key Findings (23-085, June 2023)

The OIG identified numerous and serious failures, including:105

  1. Cellmate directive violated: Psychology Dept’s July 30 requirement106 was emailed to over 70 staff and, according to supervisors, communicated to SHU staff, though several SHU staff told OIG they did not know of it; USMS notified MCC August 8 the cellmate was leaving; no action.107
  2. Records falsified: Count slips and round sheets falsified.108 Multiple employees created false documentation;109 USAO SDNY declined prosecution of other employees for false records on the day before and the day of the death.110
  3. Criminal prosecution → dismissal: CO Tova Noel and Material Handler Michael Thomas charged federally for falsifying records — charges dismissed after successful deferred prosecution agreements.111
  4. Camera failure ignored: DVR system failed July 29;112 MCC discovered August 8; not repaired before the death.113 FBI forensic analysis found 3 faulty hard drives; system never successfully reassembled.114
  5. Staffing failure: an unnamed Material Handler worked 24 consecutive hours;115 the unnamed Material Handler told OIG the 10 p.m. count was skipped because they were tired.116
  6. Cell security failure: Excess linens in cell;117 records did not show when the cell was last searched;118 multiple nooses constructed and not discovered.119

The OIG found no evidence contradicting the FBI’s determination that no criminality was associated with the death.120

Aftermath

Guards Tova Noel and Michael Thomas charged with falsifying records; charges dismissed via DPA.121 Other employees who falsified records on the day before and the day of the death were not prosecuted.122 Barr recalled being informed before action and said he was not involved in prosecutorial decisions.123 Barr recalled quickly reassigning the warden124; the new BOP director was announced August 19, 2019.125 Eight OIG recommendations126 — all accepted by BOP.127
