Suicide Watch Protocols
Edition label: 2026-10
Context: Federal Bureau of Prisons (BOP) protocols
for monitoring high-risk detainees at Metropolitan Correctional Center
(MCC)1
Relevance: Multiple simultaneous protocol failures
directly preceded J. Epstein’s death2
Standard Protocol
The OIG report describes distinct requirements rather than one universal suicide-watch protocol: suicide watch involved direct continuous observation3; twice-hourly rounds and institutional counts were general SHU duties4; and the post-observation cellmate direction named Epstein, although an MCC New York local policy also required that inmates discharged from suicide watch be assigned a cellmate:5 - Continuous or frequent observation (step-down levels)6 - Cellmate assignment when removed from formal suicide watch7 - Documented SHU rounds at least twice each hour, once in each half-hour, on an irregular schedule no more than 40 minutes apart8 - Institutional population counts9
Failures in Epstein Case
The following failures were all in effect on the night of August 9–10, 2019, though their onset was staggered over the preceding weeks:10
- Removed from suicide watch — after the unresolved July 23 incident, which officials treated as a possible suicide attempt, Epstein was stepped down from formal suicide watch11
- No cellmate assigned — a written July 30 Psychology Department direction required Epstein to have an appropriate cellmate after observation ended12; no replacement cellmate was assigned after his cellmate was transferred out on August 913
- Required SHU rounds not performed — Tova Noel and Michael Thomas failed to conduct checks14
- Falsified logs — both guards falsified records to indicate checks had been made15
- DVR not recording — see dvr-failure; the camera covering his tier was live but not recording16
- Institutional counts not done — the regular institutional headcount was not performed17
William P. Barr described this as “a perfect storm of screwups”18. On the missed checks, he said it was apparently a consistent practice; the OIG reported finding no evidence contradicting the FBI’s determination of no criminality in how Epstein died.19
Institutional Response
Barr described his response to the death as follows:20 - Appointed a new BOP Director and Deputy Director, Kathy Hawk Sawyer and Tom Kane212223 - Reassigned the MCC warden24
Barr also recalled stopping new intake to MCC and believed he redirected it to Brooklyn MDC; he did not date that action.25
Guards Noel and Thomas were indicted for falsifying records26; both entered deferred prosecution agreements, and the charges were dismissed after they fulfilled the agreements27.
